What this video covers

A plain-language walkthrough, in the order you will actually encounter it — which law applies to your marriage, the exact documents both of you must carry, how the same-day route under the Punjab Compulsory Registration of Marriage Act, 2012 differs from the 30-day notice under the Special Marriage Act, 1954, what happens at the Marriage Officer's office on the day, and when a protection petition in the High Court is the right first step rather than an afterthought.

  • Which of the two routes fits your situation, and why it matters
  • The full document checklist for both parties and the witnesses
  • What the 30-day notice period really involves
  • Where couples most often lose time, and how to avoid it
  • Protection petitions: timing, procedure and what the Court orders

Which route? ਕਿਹੜਾ ਰਸਤਾ?

Find out in three questions

Choosing the wrong statute is the most expensive mistake couples make, and it is usually made before they speak to anyone. Answer three questions and you will know which route fits, and why.

Route finder

ਤਿੰਨ ਸਵਾਲ, ਤੇ ਜਵਾਬ ਮਿਲ ਜਾਵੇਗਾ

Do you and your partner follow the same religion?

This decides which statutes are open to you. Nothing here is stored or sent anywhere.

Will the certificate be used for a visa or immigration file?

Spouse visas, PR applications and consular filings have stricter expectations than domestic use.

Is either family opposing the marriage?

Answer honestly. If there is a threat, the sequence of steps changes, and it changes urgently.

Recommended route

Same-day marriage — Punjab Act, 2012

Your marriage can be registered the same working day.

Bring both Aadhaar cards, both age proofs and two witnesses.

This is guidance, not advice on your particular facts — the statute that applies depends on details a form cannot capture. One free consultation will confirm it.

About ਵਕੀਲ ਬਾਰੇ

Advocate J S Rahi

Thirty-three years of matrimonial practice in Punjab, conducted from Ludhiana and argued at Chandigarh.

Court marriage looks like paperwork until something goes wrong with it. A wrong choice of statute costs a couple a month they did not have. An affidavit drafted carelessly gets a spouse-visa file rejected two years later. A protection petition filed a week late arrives after the damage.

This practice exists because those failures are avoidable. Advocate J S Rahi has appeared in marriage, registration, protection and divorce matters before the Punjab & Haryana High Court and the district and family courts across Punjab since 1993 — long enough to know which registrar's office is slow in which district, and which route a particular couple should actually take.

Couples arrive here from Ludhiana and from villages six hours away, and often in a hurry and under pressure from home. So the working method is simple: documents reviewed on WhatsApp before you travel, one honest answer about what is and is not possible, the scope settled before work starts, and the phone answered at whatever hour you are able to call.

How it works ਪ੍ਰਕਿਰਿਆ

From first message to marriage certificate

Five steps. Most couples complete the first three without leaving home.

Day 0 · 10 minutes

Send your documents on WhatsApp

Photograph both Aadhaar cards and both age proofs and send them across. Advocate Rahi reviews them personally and tells you what is missing before you spend money on travel.

Day 0 · Same call

We choose the right route for your purpose

Same-day registration under the Punjab Act of 2012, or the Special Marriage Act with its 30-day notice. Whichever suits your purpose — including a future visa application — is explained in full before anything is filed.

Before you travel

Affidavits and forms drafted in advance

All affidavits, applications and registration forms are prepared at this end and kept ready, so your visit is signing and appearance, not drafting and queuing.

The appointed day

Solemnisation, witnesses and registration

You attend with two or three witnesses. The marriage is solemnised and the registration is filed the same day on the Punjab Act route. Advocate Rahi is present throughout.

After

Certificate delivered — and protection, if needed

The marriage certificate is collected and couriered to you. Where your family is hostile, a protection petition is filed in the High Court at the same time, not weeks later.

Signing the register. Two witnesses attend; parents need not.

Bring with you ਜ਼ਰੂਰੀ ਦਸਤਾਵੇਜ਼

Tick off what you already have.

That is everything. Nothing is stopping you from being married this week.

Send the list and book a date

Affidavits, applications and registration forms are drafted by this office. You do not need to arrange them. Passport and visa pages are also needed for NRI or foreign-national parties.

If your family is threatening you

Do not wait to see whether it settles down. A protection petition under Article 226 can be filed in the Punjab & Haryana High Court and is frequently listed within a day or two, with directions issued to the SSP of your district.

We had four days before my sister-in-law's family found out. Advocate Rahi checked our papers on WhatsApp the same night, told us exactly what was missing, and we were legally married and registered on the Thursday. He did not once make us feel rushed or judged.

My family was threatening both of us. The protection petition was filed at the High Court and the order to the SSP came through faster than anyone had led us to expect. Having someone answer the phone at 11 at night mattered more than I can explain.

Mutual consent divorce after eleven years apart. He applied for waiver of the six-month wait and explained honestly that it might not be granted. It was. The settlement terms he drafted have not caused a single dispute since.

We are in Brampton and needed the marriage certificate apostilled for my wife's PR file. Everything was handled from Ludhiana over video calls and courier. IRCC accepted the documents without a single query.

Two other lawyers told us we would have to wait thirty days. Advocate Rahi explained why that only applied to one of the two routes and which one we actually needed. We married the next morning. The difference was simply knowing the law properly.

He quoted one figure at the start and that is what we paid. Coming from a village near Barnala, I had been warned to expect the amount to keep growing. It did not.

Questions ਆਮ ਸਵਾਲ

Straight answers

The eight questions that come up in almost every first call.

Usually, yes. The marriage is solemnised the same day under your personal law — an Arya Samaj, Gurudwara or temple ceremony — and then registered under the Punjab Compulsory Registration of Marriage Act, 2012, which carries no notice period. With identity documents, age proof and two witnesses in order, the whole thing is normally finished within one working day.

Be careful of anyone promising a same-day marriage under the Special Marriage Act. That Act requires a 30-day public notice and cannot be shortened. The two routes are different things, and choosing the wrong one is the single most common mistake couples arrive here having already made.
Each party: Aadhaar card (original and two copies), age proof such as a 10th class certificate, birth certificate or passport, four passport-size photographs, and address proof. Two to three witnesses must attend with their own Aadhaar cards. If either of you was married before, bring the divorce decree or the previous spouse's death certificate. NRI and foreign-national parties should bring passport and visa pages.

Affidavits, applications and registration forms are drafted by this office — you do not need to arrange them. Send photographs of what you have on WhatsApp and you will be told what is missing before you travel.
The bride must have completed 18 years and the groom 21 years. Neither party may have a living spouse, and both must be capable of giving free consent.

Parental consent is not a legal requirement, and your parents do not need to be present or informed. A marriage between two consenting adults cannot be set aside on the ground that a family disapproved of it. Your witnesses can be friends, cousins or colleagues.
A protection petition can be filed in the Punjab & Haryana High Court under Article 226 of the Constitution. The Court routinely issues directions to the Senior Superintendent of Police of the district concerned to assess the threat and provide protection, and these matters are frequently listed within a day or two of filing.

Do not wait to see whether the situation settles. Where a threat is real, the petition should be filed immediately before or immediately after the marriage. Advocate Rahi files these personally at Chandigarh, and this line is answered at any hour.
Mutual consent divorce under Section 13B of the Hindu Marriage Act runs in two motions with a statutory six-month cooling-off period between them. Following Amardeep Singh v. Harveen Kaur (Supreme Court, 2017), that period can be waived where the parties have lived apart for a long time and settlement terms are final. Many mutual consent files conclude in two to four months.

Contested divorce under Section 13 depends on evidence and on the court's list, and takes considerably longer — often a year or more. Anyone guaranteeing you a date for a contested matter is guessing. You will be given a realistic view of your own case, not an optimistic one.
Fees are not published, because a figure quoted before hearing your facts would not be an honest one. What the work costs depends on which statutory route applies, whether registration follow-up or a protection petition is involved, and which district the matter runs in.

Speak to Advocate Rahi directly on +91 98720 21021. The scope and the fee are settled and confirmed to you before any work begins, and nothing is added afterwards.
Largely, yes. Marriage certificates and affidavits are prepared in the form visa and immigration authorities accept, with apostille or Ministry of External Affairs attestation arranged where your destination country requires it. NRI divorce matters can often be conducted through a properly executed power of attorney, and foreign decrees can be recognised in India.

Consultations are held over video, and documents move by courier. Families in Canada, the UK, Australia, the United States and Italy use this service regularly.
No, and it is a large part of this practice. Matters are conducted in every district of Punjab and in the tehsil courts within them, and Advocate Rahi travels where the matter requires it.

The one thing worth doing is sending photographs of your documents on WhatsApp before you set out. Most wasted journeys are caused by one missing paper that could have been identified in five minutes from home.
